Child Abuse

Child abuse is willfully inflicting cruel or inhuman corporal punishment upon a child (persons under age 18). Penal Code section 273a. Child abuse may also consist of extreme neglect. The penal code prohibits willful conduct committed under circumstances conditions likely to produce great bodily harm or death. The case may be filed as a misdemeanor or as a felony, depending on the alleged seriousness of the circumstances.
County investigators, school staff or others may claim that a child exhibits injuries. Sometimes social workers report that a child has been neglected in the home and is uncared for.
Defenses to the charge may include lack of custody of the child in cases of neglect. The attorney will review the police report and interview witnesses and set the case for trial or in some cases negotiate pleas with conditions of probation including parenting classes and cooperation with appropriate county agencies.
